  On Thursday, 19 May 2022, at 08H30 the Special Tribunal will hear the application for leave to appeal against a judgment and order dated 8 March 2022.
• Media Statement: Judge Lebogang Modiba named new President of the Special Tribunal, with Judges Johannes Daffue and Soma Naidoo as new Additional Members, 09 May 2022
  Judge Lebogang Modiba has been named as the new President of the Special Tribunal with two High Court of the Free State Division Judges Soma Naidoo and Johannes Daffue, as new additional members. The appointments are effective from 1 May 2022.

  The Special Tribunal will on Wednesday (tomorrow) morning hear the legal arguments in the review application over the R431 million schools decontamination, disinfection, deep cleaning and sanitization contracts in several Gauteng schools.

  The Special Tribunal has dismissed with costs an application by the SA Music Legends Forum which sought to be joined as an intervening party in the R2, 4 million claim against former SABC Chief Operations Officer (COO) Hlaudi Motsoeneng and 10 Other former Executives.
• Media Statement: Clarity on the Review Application Hearing in the Digital Vibes hearing before the Special Tribunal, 01 September 2021
  The Special Tribunal notes media reports that the review application in the matter of Digital Vibes will be heard on the 16th September 2021. The application by the Special Investigating Unit (SIU) to review and set aside the contract by the Department of Health awarded to Digital Vibes has not been enrolled on the said day.

  Former Transnet Executive for Capital Projects, Mr Linyenga Herbert Msagala, has been ordered to pay back an amount of R26, 4 million to his former employer after being found guilty of the disgorgement of the secret profits while in the employ of the entity.

  The Special Tribunal will on Tuesday (tomorrow) hand down judgment in the R18, 4 million fraud and corruption case involving the former Transnet Executive for Capital Projects, Mr Linyenga Herbert Msagala.

  The week-long trial of the former Chief Financial Officer (CFO) of the Gauteng Department of Health, Kabelo Mantsu Lehloenya, which was scheduled to begin in the Special Tribunal today (Monday) and run until Friday, could not commence after she filed a third-party notice dragging Premier David Makhura and the Provincial Government, the Gauteng Department of Health’s Chief Operating Officer Arnold Malotana, its Chief Director, Thandiwe Lorraine Pino and its Head of Department Mkhululi Lukhele as well as two of its PPE suppliers Ledla Structural Development and Beadica 423 CC, to the civil recovery proceedings.

  The Special Tribunal has dismissed the reconsideration application by the Chachulani Group Investments Holdings implicated in the R431 million decontamination cleaning contract by the Department of Education in Gauteng Province.

  The Special Tribunal on Wednesday heard an application for leave to amend the particulars of claim in the matter between the Special Investigating Unit (SIU) and three executives of the Lepelle Northern Water Board (LNWB) in Limpopo, namely, its former Chief Executive Officer, Kgahliso Phineas Legodi, Carel Schmahl, the incumbent General Manager for Operations and Johann Christiaan Kilian the former Chief Financial Officer.

  The SABC and the SIU’s application to review and set aside the 2016 decision by the SABC’s Operations Committee, chaired by its former Chief Operations Officer (COO), Hlaudi Motsoeneng, and comprised of several other former SABC executives, to make a gratuitous payment of R50,000 to each of several music legends, was due to be heard in the Special Tribunal today, 22 Jul 2021.

  The Special Tribunal has dismissed with costs leave to appeal its judgment by the former Transnet Group Executive for Capital Projects, Mr Linyenga Herbert Msagala, who is alleged to have improperly benefited in an R18, 4 million tender irregularities during his incumbency at the Enterprise. Judge Billy Mothle dismissed the application on Tuesday.

  The trial into the alleged financial irregularities involving the former Transnet Group Head for Capital Projects, Mr Herbert Msagala, got underway in the Special Tribunal sitting at the South Gauteng High Court in Johannesburg on Monday, 3rd May 2021.
• Media Statement: OR Tambo District Municipality’s R4, 8 Million “Covid-19 Door-To-Door Campaign” declared Unlawful, 20 Apr 2021
  The Special Tribunal has granted an order declaring that the R4, 8 million contract entered into between the OR Tambo District Municipality in the Eastern Cape and Phathililizwi Training Institute (Phathilizwi) for the procurement of services for a Covid-19 related door to door campaign (the contract) under Tender No: ORTDSMU 05-18/19 to be unlawful. The Special Tribunal also declared the contract to be invalid and set it aside.

  The SIU and Zain Brothers CC (“Zain Brothers”) have amicably reached a settlement agreement in an application by the SIU to review and set aside the R4, 8 million contract entered into between the KwaZulu-Natal Department of Social Development (“KZN Social Development”) and Zain Brothers for the supply of the 12 000 blankets KZN Social Development sourced from Zain Brothers as part of its response to the Covid19 pandemic.

  The Special Tribunal has declared the interdict granted against the Government Employees Pension Fund (“GEPF”) not to pay the pension fund of the former Chief Financial Officer (CFO) of the Department of Agriculture, Land Reform and Rural Development (“the Department”), Mr Jacob Basil Hlatswayo, to have lapsed.

  The Special Tribunal has dismissed the application brought forward by the two contractors allegedly involved in the R40 million Beit Bridge Border Fence Project in Limpopo who had challenged the Tribunal’s jurisdiction to adjudicate on the civil recovery proceedings in the matter.

  The Special Tribunal has interdicted and restrained the former Chief Executive Officer (CEO) of the Lepelle Northern Water in Polokwane, Limpopo from disposing off his four immovable properties in both Limpopo and Gauteng provinces, pending the finalization of the civil proceedings against him into the alleged R2, 2 billion Giyani Water Project tender irregularities.

  The Special Tribunal has ordered twenty one (21) respondents to forfeit the monies received from the Gauteng Department of Health through the Ledla Structural Development (Pty) Ltd back to the State as part of recouping R38, 7 million allegedly spent wrongfully in the procurement of Personal Protection Equipments (PPEs).

  The Special Tribunal of South Africa has confirmed the preservation order against former Transnet Chief Executive for Capital Projects, Mr Herbert Linyenga Msagala, and ordered that both his movable and immovable properties be forfeited to the State in an effort to recoup an estimated amount of R18, 4 million.
