The Minister of the Department of Justice and Constitutional Development, Ms. Mmamoloko Kubayi, welcomes the swift action taken to suspend the prosecutor pending the institution of appropriate disciplinary action by National Prosecutions Authority. A warrant of arrest has been issued against the prosecutor by Magistrate at Kwaggafontein Magistrates Court, Mpumalanga, on Monday, 18 May 2026.
This happened after he failed to arrive in court for the continuation of the bail application in the matter of State versus Madoda Johannes Sibanyoni and Others, wherein the accused face charges of Extortion and money laundering.
Minister Kubayi expressed disappointment and regret in the manner the events turned out at the Kwaggafontein Magistrate Court.
“It is in the interest of justice that the accused persons are given an opportunity to respond to the charges brought against them in the court of law. Technical lapses of this nature, especially by state institutions, must be avoided so that the public does not lose confidence in our justice system,” said Minister Kubayi.
Furthermore, the Minister implored on NPA to put in place systems and process in place to ensure that such incidence don’t occur again in the future.
