The Deputy Minister of Justice and Constitutional Development, Mr. Andries Nel, has welcomed today’s ruling by the Grand Chamber of the European Court of Human Rights (ECHR) in favour of South African Olympic champion, Caster Semenya. The Court found that Semenya’s appeal against discriminatory athletics regulations had not been properly heard by the Swiss Federal Tribunal.
Deputy Minister Nel described the ruling as a major victory for justice, equality, and the rights of intersex athletes globally.
“Caster Semenya’s case has ignited global conversations around human rights and, in particular, the rights of LGBTIQ+ persons in sport. Her resilience has made her a symbol of dignity and advocacy, and has highlighted the ethical and human rights concerns surrounding gender regulations in sport”, said Deputy Minister Nel.
The Deputy Minister further said “Her legal battles have amplified calls for dignity, non-discrimination and fairness for intersex persons. Her courage has inspired broader advocacy for bodily integrity and the right to compete without discrimination.”
The Deputy Minister further commended the South African Human Rights Commission, the Commission for Gender Equality, and the Department of Sport, Arts and Culture for their critical roles in supporting Semenya’s fight for justice.
“Today’s ruling marks a pivotal moment in the global movement for inclusivity, fairness, and human dignity in sport”.
