The Ministry of Justice and Correctional Services wishes to correct recent media reports on the funding of the National Prosecuting Authority, particularly in respect of donations.
In response to a parliamentary question post by Honourable Werner Horn MP on the status of *donations in kind* to the NPA, the Ministry clarified that a new protocol has been established to regulate *non-cash donations in kind* which includes skills and expertise. This protocol is established to safeguard the integrity and independence of the NPA.
In respect of *financial donations* these are channelled through a general RDP fund established by the Reconstruction and Development Programme Act of 1994. The RDP Fund is a general pool of money that sits with National Treasury. Monies are appropriated through normal treasury processes. There is no way that a donor can directly fund NPA investigations or any of is operations.
The State has a constitutional obligation to fund the operations of the NPA. President Rampahosa has set the recapacitation of law enforcement institutions as a key priority. In the 2022/23 financial year, over R1.1 billion was reprioritised from the general fiscus and allocated to the NPA to fight corruption, gender-based violence and crime in general.
