Tomorrow (Friday) marks the last day of National Wills Week and we bring you another perspective, this time from the Justice Department. Over the years many families were split by the discovery that they were left out of the Will, mostly by men who either did not tell their wives that they have another family or in a polygamous marriage. There's just so many incidents of this nature in our country that leave devastation to affected members. So what provisions are there in the justice system that deal with customary laws and what is it that those who find themselves in such situations can do to contest a Will?

Across South Africa, offices of the master of the high court are buckling, and attorneys who must deal with them daily are at their wits’ end. Lawyers are increasingly expressing dissatisfaction with the deepening dysfunctionality of the offices of the Master of the High Court. They highlight that the Master’s Office is causing significant delays, lasting months or even years, for crucial legal administrative procedures that should ideally be completed within weeks. The Master’s Office is responsible for overseeing numerous legal processes, including the winding up of estates of the deceased, handling bankruptcy and liquidation matters, and managing hundreds of millions of rands for the Guardian’s Fund. We find out more on the state of the Masters cause, and the offices plans to address this administrative nightmare.

MINISTER LAMOLA TO LAUNCH DECEASED ESTATE ONLINE REGISTRATION SYSTEM

The Minister of Justice and Correctional Services Ronald Lamola is scheduled to officially launch the Masters’ Deceased Estate Online Registration System on 10 October 2023. The Minister was be supported by Deputy Minister John Jeffery and Director General Adv. Doc Mashabane.

Justice minister Ronald Lamola announced on Tuesday during his budget vote speech in the National Assembly that his department is developing an online system for the reporting of deceased estates, which is expected to come on stream in the current financial year. Chief master in the Department of Justice and Constitutional Development, Martin Mafojane, says the plan is to make things easier for citizens and they should expect the system to work in July.
