Establishment
The establishment of the Secretariat consists of officials of the Department of Justice who occupy the following posts:
- a principal state law adviser who acts as the Secretary of the Board;
- six senior state law advisers who perform the necessary research, compile research papers, consult with role-players, and draft amendments to the rules; and
- a secretary.

Present incumbents of posts
The present incumbents of the posts are:
- Principal State Law Adviser – Director of Secretariat and Rules Board Secretary: Ms Clair Hartley
- Senior State Law Advisers – Researchers: Ms Sandra Govender, Mr Nkosinathi Maseko, Mr Moses Setshedi, Mr Zaheer Minty, Mr David Neke
- One vacant Senior State Law Adviser post has been filled and the incumbent will assume duty on 1 December 2008.
- Secretary to the Director: Mr Nicholas Maake
