Today’s arrests and seizure of assets by our law enforcement agencies are a confirmation that government’s resolve to combat corruption remains unwavering. A multi-agency investigation team constituted by the Directorate of Priority Crime Investigations, commonly known as the Hawks – South African Police Service; the National Treasury and the Asset Forfeiture Unit (AFU) culminated in the simultaneous takedown operation in which a total of eight people (5 businessmen and 3 government employees) were today arrested in Durban, Pietermaritzburg and Cape Town. They will appear before court on charges that include corruption, fraud and money laundering to the tune of R 200 million. The investigation was initiated in 2008 following allegations of procurement irregularities in which two Provincial Health Departments (Kwazulu-Natal and Northern Cape) and one company, Intaka Holdings (Pty) Ltd were involved.

As the lead department for the Victims Charter, the DOJCD is responsible for coordination of programme implementation of JCPS Departments. In 2007, the DOJCD and departments and Commissions on Gender and Human Rights, developed a Five Year National Implementation Plan. The implementation plan formed the basis of work of the DOJCD in developing a Draft Policy for Implementation of the Victims Charter.

Two hundred and twenty three (223) persons appeared as accused persons before dedicated courts in 172 cases processed nationally. These courts were designated by the Justice and Constitutional Development Minister Jeff Radebe as an integral part of the National Security plan intended for the FIFA 2010 World Cup tournament. Of these, 139 cases have been disposed of, resulting in finalisation rate of 80,8%. One hundred and four (104) cases resulted in convictions, translating into 60.4% conviction rate so far. Twenty eight (28) cases were withdrawn mainly due to lack of sufficient evidence, whilst seven cases resulted in acquittals. A further 33 cases have yet to be finalised.

The South African Constitution acknowledges that all citizens, and people in the South African borders, have the right to be tried in a language that the accused person understands. South Africa (SA) has seen, with the hosting of the 2010 FIFA World Cup, a lot of foreigners. Bearing in mind that there will be criminal activities during the tournament, the Department of Justice and Constitutional Development, through Justice College, trained Court Interpreters with the aim of equipping them with skills that will ensure effective justice during the event.

We have come a long way as a nation from the time we bid to host this event, and already everyone can feel it is here! Just next week, the eyes of the whole world will be fixed on South Africa, as our own national team Bafana Bafana takes on Mexico and the rest of the World. Our people and the rest of the world will be treated to a football spectacular that is without precedence in the history of the tournament. One question that has been asked repeatedly is whether South Africa will be ready to host this mega event. The Regulations relating to Sheriffs, 1990, made under section 62 of the Sheriffs Act, 1986 (Act 90 of 1986), were amended by Government Notice No. R.1293 published in Government Gazette No. 31658 of 5 December 2008.
Since the commencement of the amending Regulations certain practical and other challenges have been experienced in the application thereof. Furthermore, certain views have also been expressed regarding the fact that some of the amending Regulations may possibly be ultra vires.

The Thuthuzela Care Centre (TCC), situated at Karl Bremer Hospital in Bellville, is one of the 21 already existing centres countrywide. The centres are one-stop facilities that have been introduced as a critical part of the country’s anti-rape strategy.

The Child Justice Act (CJA) was signed into law on 14 May 2008 and comes into effect on 1 April 2010.
In the past 10 years, a separate criminal Justice system for children under the age of 18 was established through the implementation of the Interim National Protocol for the Management of Children Awaiting Trial. This was supported by the National Inter-sectoral Child Justice Steering Committee (ISCCJ) which strategies and advice on policy matters and operational challenges in managing children in conflict with the law.
The CJA will legislatively support the practice of the past 10 years

The Child Justice Act of 2008 comes into effect today 1 April 2010.
•Establishes a criminal justice system for children
•Expands and entrenches the principles of restorative justice in the criminal justice system for children, while ensuring their responsibility and accountability for crimes committed
•Places an increased emphasis on the effective rehabilitation and re-integration of children in order to minimise re-offending
•The Act provides that :
i) a child under the age of 10 years does not have criminal capacity and cannot be prosecuted for that offence
ii) a child older than 10 years but below the age of 14 years is presumed to lack criminal capacity unless the state proves that he/ she has criminal capacity....

Subsequent to the tabling, amendments to a few regulations were proposed, some of which emanate from the Portfolio Committee. Once the regulations have been approved by Parliament, the final version will be made available. The regulations reflect the version as tabled with the proposed amendments.
