Invitation to submit comments on the proposed Rationalisation of Magisterial Districts for the Eastern Cape and KwaZulu-Natal Provinces

The Minister of Justice and Correctional Services, Adv. Michael Masutha calls on members of the public to submit comments regarding the proposed rationalisation of magisterial district for the Eastern Cape and KwaZulu Natal Provinces. The notices with an intention to create districts and courts were published in the Government Gazette No. 41552 of 29 March 2018.
The rationalisation project seek to redress the legacy of the spatial injustices of the past and create a courts’ jurisdictional footprint which advances access to justice and give effect to the purport of the National Development Plan.
In terms of this project, magisterial districts are aligned to municipality boundaries as redrawn by the Municipal Demarcation Board (MDB), whilst the areas of the jurisdiction of the divisions of the high court are aligned to provincial boundaries as determined in terms of the Constitution to the extent possible.
In the Eastern Cape Province, the notice seeks to establish 8 magisterial districts in respect of the one (2) Metropolitan Municipality and four (6) District Municipalities. The Notice further contemplates the establishment of 22 sub-districts for the 8 magisterial districts which are aligned to the local municipalities of each District Municipality.
In respect of the KwaZulu Natal Province the published Notice seeks to establish Ten (10) magisterial districts in respect of the 1 Metropolitan municipality and Nine (9) District Municipalities established in the province. The Notice further contemplates that the establishment of 24 sub-districts for the 10 magisterial districts which are aligned to the local municipalities of each District Municipality.
