Expungement of a Criminal Record in terms of the Criminal Procedure Act, 1977 (Act 51 of 1997)

    (To be completed by a person who has a criminal record older than 10 years and upon whom a fine of not more than R20 000 was imposed and has not been sentenced to a period of imprisonment)
  • J745 Eng / Afr - Form B: Application for expungement of a criminal record (Section 271C(2)(a) of the Criminal Procedure Act, 1977 (Act No. 51 of 1977)
    (To be completed by a person who wants to have his or her criminal record expunged on the basis that his or her conviction was as a result of legislation based on race or which would not be regarded as an offence under the constitutional dispensation)
  • J746 Eng / Afr - Form C: Application for expungement of a criminal record (Section 271C(2)(b) of the Criminal Procedure Act, 1977 (Act No. 51 of 1977)
    (To be completed by a person who has been convicted of certain offences in terms of legislation prior to 1994)

Expungement of a Criminal Record in terms of the Child Justice Act, 2008 (Act 75 of 2008)

Section 87 of the Child Justice Act provides for the expungement of records of certain convictions and diversion orders
(1) (a) Where a court has convicted a child of an offence referred to in Schedule 1 or 2, the conviction and sentence in question fall away as a previous conviction and the criminal record of that child must, subject to subsections (2), (3) and (5), on the written application of the child, his or her parent, appropriate adult or guardian (hereafter referred to as the applicant), in the prescribed form, be expunged after a period of....read more pdf
